SECTION 21 - Compulsory:

If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

Notice:

A party to the Terms claiming a dispute ('Dispute') has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

Resolution:

On receipt of that notice ('Notice') by that other party, the parties to the Terms ('Parties') must:

(a) Within 30 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree

(b) If for any reason whatsoever, 30 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the President of the Conflict Resolution Service or his or her nominee;

(c) The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation

(d) The mediation will be held in Amman, Jordan.

Confidential

All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

Termination of Mediation:

If 3 months have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

Venue and Jurisdiction.

The Purchase Services offered by Barcode Jackets Co is intended to be viewed by residents of Jordan. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Amman, Jordan.

Governing Law.

The Terms are governed by the laws of Amman, Jordan. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relatin.

تظل التزامات ومسؤوليات الأطراف المتكبدة قبل تاريخ الإنهاء سارية بعد إنهاء هذه الاتفاقية لجميع الأغراض.

شروط الخدمة هذه سارية ما لم يتم إنهاؤها من قبلك أو من قبلنا. يمكنك إنهاء شروط الخدمة هذه في أي وقت عن طريق إخطارنا بأنك لم تعد ترغب في استخدام خدماتنا، أو عندما تتوقف عن استخدام موقعنا.

إذا فشلت، في حكمنا الوحيد، أو اشتبهنا في أنك فشلت، في الالتزام بأي شرط أو شرط من شروط الخدمة هذه، فيجوز لنا أيضًا إنهاء هذه الاتفاقية في أي وقت دون إشعار مسبق وستظل مسؤولاً عن جميع المبالغ المستحقة إلى تاريخ الإنهاء ويتضمنه؛ و/أو وفقًا لذلك قد يمنعك من الوصول إلى خدماتنا (أو أي جزء منها).

تشكل شروط الخدمة هذه وأي سياسات أو قواعد تشغيل منشورة من قبلنا على هذا الموقع أو فيما يتعلق بالخدمة الاتفاقية الكاملة والتفاهم بينك وبيننا وتحكم استخدامك للخدمة، وتحل محل أي اتفاقيات ومراسلات ومقترحات سابقة أو معاصرة ، سواء كانت شفهية أو كتابية، بينك وبيننا (بما في ذلك، على سبيل المثال لا الحصر، أي إصدارات سابقة من شروط الخدمة).

لا يجوز تفسير أي غموض في تفسير شروط الخدمة هذه ضد الجهة التي قامت بصياغة الاتفاقية.

القسم 18 - القانون الحاكم

تخضع شروط الخدمة هذه وأي اتفاقيات منفصلة نقدم بموجبها الخدمات لك وتفسر وفقًا لقوانين الأردن، بلد موطننا.

القسم 21 - إلزامي:

إذا نشأ نزاع عن الشروط أو كان يتعلق بها، فلا يجوز لأي من الطرفين بدء أي إجراءات محكمة أو محكمة فيما يتعلق بالنزاع، ما لم يتم الالتزام بالبنود التالية (باستثناء الحالات التي يتم فيها طلب انتصاف تمهيدي عاجل).

يلاحظ:

يجب على الطرف في الشروط الذي يدعي أن النزاع ("النزاع") قد نشأ بموجب الشروط، تقديم إشعار كتابي إلى الطرف الآخر يوضح بالتفصيل طبيعة النزاع والنتيجة المرجوة والإجراء المطلوب لتسوية النزاع.

دقة:

عند استلام هذا الإشعار ("الإشعار") من قبل ذلك الطرف الآخر، يجب على أطراف الشروط ("الأطراف"):

(أ) في غضون 30 يومًا من تاريخ الإشعار، حاول بحسن نية حل النزاع على وجه السرعة عن طريق التفاوض أو أي وسيلة أخرى قد يتفق عليها الطرفان بشكل متبادل

(ب) إذا لم يتم حل النزاع لأي سبب من الأسباب، بعد 30 يومًا من تاريخ الإشعار، يجب على الطرفين إما الاتفاق على اختيار وسيط أو طلب تعيين وسيط مناسب من قبل رئيس حل النزاع الخدمة أو من ينوب عنه؛

(ج) يتحمل الطرفان المسؤولية بالتساوي عن الرسوم والنفقات المعقولة للوسيط وتكلفة مكان الوساطة، ودون تحديد ما سبق، يتعهدان بدفع أي مبالغ يطلبها الوسيط كشرط مسبق لبدء الوساطة. يجب على كل طرف أن يدفع التكاليف المرتبطة بالوساطة

(د) ستعقد الوساطة في عمان، الأردن.

تعتبر جميع الاتصالات المتعلقة بالمفاوضات التي تجريها الأطراف الناشئة عن بند حل النزاع هذا والمتعلقة به سرية ويجب التعامل معها قدر الإمكان على أنها مفاوضات "دون الإخلال" لغرض قوانين الإثبات المعمول بها.

إنهاء الوساطة:

إذا انقضت 3 أشهر بعد بدء الوساطة في النزاع ولم يتم حل النزاع، يجوز لأي من الطرفين أن يطلب من الوسيط إنهاء الوساطة ويجب على الوسيط أن يفعل ذلك.

المكان والاختصاص القضائي.

إن خدمات الشراء التي تقدمها شركة Barcode Jackets Co مخصصة لإطلاع المقيمين في الأردن عليها. في حالة وجود أي نزاع ينشأ عن أو فيما يتعلق بالموقع، فإنك توافق على أن المكان الحصري لحل أي نزاع سيكون في محاكم عمان، الأردن.

القانون الذي يحكم.

تخضع الشروط لقوانين عمان، الأردن. أي نزاع أو خلاف أو إجراء أو مطالبة مهما كانت طبيعتها تنشأ عن أو تتعلق بأي شكل من الأشكال.
